The following paragraphs are taken word-for-word from our puppy pet contract, except for the signature lines, puppy specifics, and personal information. Please read the entire contract below prior to picking up your puppy. We reserve the right to modify this contract – please save a screenshot for reference when you join our waiting list.
Sugar and Spice Cockapoos Contract and Guarantee
State of South Carolina Rules and Regulations govern all warranties and guarantees.
Puppies sold by Sugar and Spice Cockapoos LLC (Seller) are honestly represented and evaluated as accurately as possible by Seller. Sugar and Spice Cockapoos LLC in no way guarantees breeding capabilities. This puppy is being sold as a pet, without breeding rights. Seller requires that your puppy be spayed or neutered by a veterinarian of your choice by twelve months of age and requires that Buyer provide documentation to Seller of that completed spay or neuter procedure by sixteen months of age. Seller does not guarantee adult size, color, or temperament of the puppy.
The above-described puppy is believed to be in good health at the time of the sale. In order to verify the good health of the puppy, Buyer must take the puppy to a licensed veterinarian within five business days of receipt of puppy. If your puppy does not eat for a period of more than 24 hours, take him or her to a veterinarian immediately. Seller will not replace a puppy or refund purchase price for a puppy that dies because Buyer waited too long to get medical help for the puppy.
If an examination by a licensed veterinarian reveals that the puppy is medically unsound so as to warrant returning puppy to Seller, Buyer must notify Seller within two business days of the examination. The veterinarian must furnish a report describing the problem, and the puppy must be returned to Seller immediately if Buyer is to receive a replacement for said puppy or refund of purchase price. Seller will not refund purchase price or replace puppy for common puppy problems, such as fleas, ticks, lice, coccidia, giardia, intestinal parasites, ear mites, or other such parasites, or other stress-induced problems such as hypoglycemia and kennel cough. Seller will not reimburse vet bills incurred by Buyer for any reason.
Puppy is guaranteed to be free of life-threatening congenital defects until one year from the date of puppy’s birth–this will be extended to three years from date of birth if NuVet supplemental vitamin is given during that entire time. Should the puppy be diagnosed with a congenital disorder within that time period, a second unassociated veterinarian must also examine the puppy. Both must determine that the quality of life will be seriously impacted and recommend euthanasia, or require continuous medical treatment throughout the puppy’s life. Buyer must provide veterinary proof of the diagnosis. Seller will refund the purchase price or replace the puppy with another of the same sex and similar coloring as soon as one becomes available. In the unlikely event of the death of the puppy, laboratory confirmation of cause of death will be required. Seller’s liability is limited to the purchase price of said puppy excluding any delivery charges, and Seller shall not assume liability for any veterinarian expenses.
The following slight genetic defects are not considered serious or life threatening and, therefore are not covered by the guarantee: umbilical hernia, un-descended testicle, kidney/bladder infection, under-bite or over-bite, grade one/two luxating patella, grade one/two heart murmur. The replacement option or refund of purchase price is only valid when health problems are attributed to a congenital problem and not due to accident, contagions, or illness.
If at any time or for any reason Buyer decides not to keep the puppy, Buyer must immediately offer to surrender puppy to Seller. Buyer must first obtain written permission from Seller before transferring ownership of the puppy to any other individual or organization.
